Petition For Conviction Review

In this page, I am trying to show publicly, the many reasons why I could not have been the perpetrator of this crime. This Petition, created by the Office of the State Attorney in and for Broward County, Florida, contains a very detailed questionnaire that is easy to follow and more importantly than anything, it is based on nothing less than the face of the record.

In my case, the entire questionnaire is answered accordingly to the evidence and the witnesses presented in my trial. Even though, my trial took place over 21 years ago, nothing has changed with the facts which were presented to the jury. Specifically, the lack of evidence to prove I was ever at the crime scene. On the contrary, there is plenty of evidence available that indicates the undeniable reality that, more likely than not, I am not in fact the perpetrator of this case. Furthermore, there is a higher probability that the DNA evidence that was viewed and considered by the trier of fact to convict me, was tainted, and therefore, such DNA evidence, should not have ever been introduced at trial.

Making this Petition available to the public, is another way for me to show that I have nothing to hide. The record speaks for itself. There has never been any possible way to place me at the scene of this crime. The physical evidence collected at this crime could have been more than likely moved, changed, hidden, altered, tampered with, planted in/on, etc. In other words, there is no way for the prosecutor to have ever placed me at the crime scene. On the contrary, it appears as if he accused me in order to match, satisfy and justify the commission of this crime. Even though, it is very possible to manipulate evidence into or at a specific crime scene, it is impossible to physically place me at this specific crime scene where I have never been to yet this is what has happened in my case.

I am praying that I get the opportunity to have my evidence retested and finally being able to show my innocence. Justice must be served!

Below, it is the Questionnaire and the Exhibits attached to the Petition for Conviction Review Unit, which was completed by me on October 20, 2021, and submitted to the Office of the State Attorney in and for Broward County, Florida.

Thank you,

Ernesto Behrens.

Justice

My name is Franziska Kaltenbach. I am a friend of Ernesto Behrens. Because I know him for the last 30 years and I believe 100% in his innocence I am publicly asking for help to obtain his freedom. He has been prosecuted, found guilty and sentenced to die in prison for a crime he did not commit. The inculpatory evidence in his case is a spot of DNA that was allegedly found on a fitted sheet, although there is no other evidence that points at him. His alibi witness at trial was rock solid and unrefuted. He presented also a medical testimony from a physician who testified at trial, unrefuted as well, that Ernesto had surgery four (4) days before this crime took place, making it physically impossible for him to commit this crime without disrupting his injuries. Equally important, Ernesto's whole defense at trial was that the State tampered with the DNA evidence. At trial, it was confirmed that the fingerprints, palm prints and shoe castings collected at the points of entry and exit did not belong to Ernesto. Also, it was confirmed that Ernesto's physical appearance did not match that of the assailant specifically, because the victim described the perpetrator as a young circumcised male and Ernesto was 31 years old at the time of the crime and uncircumcised. Anyway, there is a lot more injustices attached to this case which reflects without a doubt, that the DNA was manipulated in this case in order to obtain a conviction. Thank you for your curiosity about this case. It may help you to understand that it can happen to anybody you know. So, please be voice ! Sincerely, Franziska Kaltenbach.
