In this page, I am trying to show publicly, the many reasons why I could not have been the perpetrator of this crime. This Petition, created by the Office of the State Attorney in and for Broward County, Florida, contains a very detailed questionnaire that is easy to follow and more importantly than anything, it is based on nothing less than the face of the record.
In my case, the entire questionnaire is answered accordingly to the evidence and the witnesses presented in my trial. Even though, my trial took place over 21 years ago, nothing has changed with the facts which were presented to the jury. Specifically, the lack of evidence to prove I was ever at the crime scene. On the contrary, there is plenty of evidence available that indicates the undeniable reality that, more likely than not, I am not in fact the perpetrator of this case. Furthermore, there is a higher probability that the DNA evidence that was viewed and considered by the trier of fact to convict me, was tainted, and therefore, such DNA evidence, should not have ever been introduced at trial.
Making this Petition available to the public, is another way for me to show that I have nothing to hide. The record speaks for itself. There has never been any possible way to place me at the scene of this crime. The physical evidence collected at this crime could have been more than likely moved, changed, hidden, altered, tampered with, planted in/on, etc. In other words, there is no way for the prosecutor to have ever placed me at the crime scene. On the contrary, it appears as if he accused me in order to match, satisfy and justify the commission of this crime. Even though, it is very possible to manipulate evidence into or at a specific crime scene, it is impossible to physically place me at this specific crime scene where I have never been to yet this is what has happened in my case.
I am praying that I get the opportunity to have my evidence retested and finally being able to show my innocence. Justice must be served!
Below, it is the Questionnaire and the Exhibits attached to the Petition for Conviction Review Unit, which was completed by me on October 20, 2021, and submitted to the Office of the State Attorney in and for Broward County, Florida.
Thank you,
Ernesto Behrens.
